Terms of Service

1. Acceptance

By accessing or using OpusImg (the “Service”), you agree to these Terms of Service and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you have authority to bind it.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. You must be at least 16 years old (or the age of digital consent in your country) to use the Service.

3. Acceptable use

You agree not to:

• Upload or generate content that is illegal, infringing, or that you lack rights to.
• Create deepfakes of real people, celebrity likenesses, or NSFW content, or attempt to bypass our content moderation.
• Reverse engineer, scrape, or overload the Service, or circumvent quotas and rate limits.
• Use the Service to violate the rights of others or any applicable law.

We may scan uploads for abuse and remove content or suspend accounts that violate these terms. See our content policy for details.

4. Your content

You retain all ownership of the images and files you upload or create (“Your Content”). You grant us a limited license to host, process, and transmit Your Content solely to operate the Service for you. We do not use Your Content to train models. AI-generated outputs may carry a watermark and signed provenance metadata (C2PA).

5. Plans, billing & trials

• Paid plans are billed in advance on a monthly or yearly basis and renew automatically until cancelled.
• Fees are non-refundable except where required by law. You can cancel anytime; access continues through the end of the paid period.
• Usage is subject to plan quotas and fair-use limits. We may change pricing on notice.
• You are responsible for applicable taxes.

6. AI features

AI outputs are provided “as is” and may be inaccurate. You are responsible for reviewing outputs before relying on them, and for ensuring your use complies with applicable law and third-party rights.

7. Intellectual property

The Service, including its software, design, and trademarks, is owned by us and our licensors. These Terms grant you no rights to our marks or to the Service except as expressly permitted.

8. Third-party services

The Service may integrate with third-party services (e.g. OpusPDF, payment, storage). Your use of those services is governed by their own terms.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or to comply with law. Upon termination, your right to use the Service ends; certain provisions survive (e.g. ownership, disclaimers, limitations).

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the maximum extent permitted by law, OpusImg will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

12. Indemnification

You agree to indemnify and hold OpusImg harmless from claims arising out of Your Content or your violation of these Terms or applicable law.

13. Governing law & disputes

These Terms are governed by the laws specified in our final, counsel-reviewed agreement. Disputes will be resolved as set out there. [Jurisdiction and dispute mechanics to be finalized in legal review.]

14. Changes

We may update these Terms. Material changes will be notified, and continued use after the effective date constitutes acceptance.
